B (Children) (Abduction-Consent-Oral Evidence) (Article 13(B))[2022] EWCA Civ 1171

The CA allowed an appeal against an order by a Deputy High Court Judge for the return of three children to Spain; the judge was wrong to refuse to hear oral evidence on consent and wrongly applied the test in Re E when considering whether the children would be at grave risk of harm.
