Re R [2005] EWCA Civ 1128

Another case on the dilemma presented where one child's future will be best served by adoption but her sibling's needs are for contact with her. This is perhaps the worst set of circumstances imaginable – the older sister wishing to be placed with the younger, but being aged 17 and facing a quite different future, having to come to terms with contact reducing from fortnightly to once a year. Her application failed and the appeal was dismissed – so she must continue to hope for the sympathy of the prospective adopters. The new Act (the Adoption and Children Act 2002) will require the Court to take into account the child's relationships with birth family members, but it remains to be seen whether or not any more orders for post adoption contact will be made.
