Permission to publish 2014 judgment concerning Ellie Butler’s death refused

Publication might prejudice any retrial

Mrs Justice Pauffley has refused permission for the publication of the judgment in the original fact finding hearing concerning the death of Ellie Butler on the grounds that her father, Ben Butler, might face a retrial in the future. Mr Butler has been sentenced to life imprisonment for Ellie's murder.

The Guardian and six other media organisations applied for access to the full judgment, given by Mrs Justice King, as she then was, in 2014. Permission to appeal the decision was refused by Pauffley J.
