First children arbitration heard

Ten days elapsed from referral to determination

The first arbitration held under the children arbitration scheme introduced in July 2016 has been determined.

The case concerned a dispute between parents about child arrangements, specific issues and general exercise of parental responsibility. The matter was referred to arbitration at the Dispute Resolution Appointment in ongoing proceedings as the court could not offer a final hearing listing for almost three months, whereas the parties needed a decision in the next couple of weeks.

The relevant dates were:

17.3.16 Application to the court
7.4.16  Allocation directions made
10.5.16 FHDRA
12.8.16 DRH
19.8.16 Appointment of the arbitrator
26.8.16 Arbitration took place
29.8.16 Decision and Determination sent out to the parties
11.10.16 The final hearing date offered by the court.

Just ten days elapsed from referral to a final decision.

An article by Farooq Ahmed, the arbitrator in that case, and Julie Stather outlining the process and benefits of children arbitrations is here.
