Law Society publishes briefing on Mental Capacity (Amendment) Bill

Bill scheduled for HoL report stage on 27 November 2018

The Law Society has published a parliamentary briefing on the Mental Capacity (Amendment) Bill which reaches its report stage in the House of Lords on 27 November 2018.

The Bill seeks Bill to amend the Mental Capacity Act 2005 in relation to procedures in accordance with which a person may be deprived of liberty where the person lacks capacity to consent. The Law Society says that, as it stands, the Bill removes vital existing safeguards for cared-for people and should be amended to avoid the unlawful treatment of the vulnerable individuals who receive care and treatment under conditions of detention.
